Terms of Use

1. Acceptance of Terms

By accessing or using Gallery Viewer ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Gallery Viewer is a professional event photography platform that allows users to create, manage, and share photo galleries. The Service includes tools for event management, gallery creation, photo uploads, and invitation management.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account. You must be at least 16 years old to create an account.

4. Acceptable Use

You agree not to: upload content that infringes any intellectual property rights; upload illegal, harmful, or offensive content; use the Service for any unlawful purpose; attempt to access other users' private galleries without authorisation; use automated tools to scrape or extract data from the Service; or interfere with the operation of the Service.

5. Content Ownership

You retain all ownership rights to the photos and content you upload. By uploading content, you grant Gallery Viewer a non-exclusive, royalty-free licence to store, display, and distribute your content solely for the purpose of providing the Service to you and your invited guests.

6. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

7. Subscription Plans and Billing

Paid subscription plans are billed for a fixed period — monthly or annual — that you pay for upfront. Subscriptions do not renew automatically: we do not store your card for future charges, and no payment method is charged again without you actively returning to your billing page and completing a new payment. As your renewal date approaches, we send reminder emails; if you do not renew, your account simply moves to the free plan at the end of the paid period, with no charge and no interruption to your existing content. Annual billing is a single upfront payment for the full annual term, typically at a discount compared to paying monthly — this discount is shown at checkout and does not change how the annual charge is billed. You can upgrade, downgrade, or switch between monthly and annual billing from your account settings; changes take effect according to the plan and timing shown at checkout.

8. Cancellations

A cancellation simply means you choose not to renew — there is nothing to "stop" charging, since nothing renews automatically. You retain access to your plan's features until the end of the period you already paid for — monthly or annual, as applicable — after which your account moves to the free plan. We do not provide prorated refunds for the unused portion of a period you've already paid for, except where required by law.

9. One-Time Purchases and Event Packages

In addition to subscriptions, we offer one-time, non-recurring purchases — including event packages that provide additional storage, galleries, photo capacity, or extended access for a specific event. One-time purchases are billed once, at the time of purchase, and do not renew or recur. A purchased event package can be applied to a new event or an existing event you own, subject to availability and your account's plan limits, and is non-transferable to another account. An event package can be self-service refunded from your event's billing page any time before that event's date. Once the event date has passed, the package is no longer refundable except where required by law. See our Refund & Cancellation Policy for full details.

10. Refunds

Subscription charges are generally non-refundable once billed — see "Cancellations" above. One-time purchases, including event packages, can be refunded before the event date as described in Section 9. Outside of that, we may, at our discretion, issue a full or partial refund for duplicate charges, billing errors, or as required by applicable consumer protection law. To request a refund, contact us through our Contact page, including the date of the charge and the email address on your account. Cancelling a subscription does not retroactively refund amounts already billed for the current or prior billing periods. See our Refund & Cancellation Policy for the full policy.

11. Payment Processing and Pricing

Payments are processed securely by third-party payment processors (including WiPay and, where enabled, PayPal). We do not store your full card details. By making a payment, you also agree to the relevant processor's terms. Prices are displayed in Trinidad and Tobago Dollars (TTD) unless stated otherwise; any prices shown in other currencies are approximate, for reference only, and the amount actually charged will be the price shown at checkout in the billing currency. We may change subscription or one-time purchase prices at any time; price changes do not affect a billing period you have already paid for, and we will give reasonable notice before a price change applies to your next subscription renewal.

12. Intellectual Property

The Gallery Viewer platform, including its design, software, and branding, is owned by Gallery Viewer and protected by intellectual property laws. You may not copy, modify, or redistribute our platform or branding without written permission.

13. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

14. Limitation of Liability

To the maximum extent permitted by law, Gallery Viewer shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

15. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or a prominent notice on the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

16. Account Deactivation

You may deactivate your account at any time from Settings → Security, after confirming your password and the on-screen acknowledgement. Deactivation is not permanent deletion: your account is suspended and you are signed out of every device, your profile and content are hidden from public view, and any active subscription is cancelled effective immediately with no prorated refund for the remaining period (see "Cancellations" and "Refunds" above) — but your data is kept as-is, not erased. To reactivate a deactivated account, contact support. We do not currently offer self-service permanent account or data deletion. Billing/transaction records are retained for as long as required by applicable law and accounting obligations, as described in our Privacy Policy.
